Manu Charters PTE Limited  – Booking Terms & Conditions

1. Booking Confirmation

All bookings are confirmed only upon:

  • Receipt of a completed booking request (where required); and
  • Payment of the full amount.

Bookings are not confirmed until written confirmation has been issued by Manu Charters.

2. Payment Terms

  • Full payment is required at the time of booking.

All prices are quoted in Fijian Dollars (FJD) unless otherwise stated and may include applicable government taxes and levies as specified in your quote.

3. Cancellation Policy

3.1 Cancellation by Client

All cancellations must be made in writing.

  • Deposits are non-refundable.
  • Cancellation within 72 hours will pay 25% of booking price
  • Cancellation within 48 hours will pay 50% of booking price
  • Cancellation within 24 hours will pay 100% of booking price

No refunds will be given for late arrivals, early returns, or unused services.

3.2 Cancellation by Manu Charters

Manu Charters reserves the right to cancel or reschedule a charter due to:

  • Unsafe weather or sea conditions
  • Mechanical or operational issues
  • Government restrictions
  • Maritime safety directives
  • Force majeure events

In such circumstances, clients will be offered either:

  • A rescheduled charter date; or
  • A full refund of payments made.

Manu Charters is not liable for additional expenses incurred by guests (including flights, accommodation, or transfers).

4. Weather & Captain’s Authority

The safety of guests and crew is paramount.

The Captain has absolute discretion to:

  • Alter the itinerary or fishing/snorkelling locations
  • Reduce charter duration
  • Return to port
  • Cancel departure

based on weather, sea conditions, tides, safety concerns, or other operational considerations.

No refund will be provided for itinerary adjustments made in the interest of safety.

5. Passenger Responsibilities

All passengers must:

  • Follow instructions given by the Captain and crew at all times
  • Wear life jackets when instructed
  • Act in a safe and respectful manner
  • Supervise children at all times

Manu Charters reserves the right to terminate a charter without refund if a guest’s behaviour compromises safety or damages the vessel.

6. Alcohol & Prohibited Substances

Responsible consumption of alcohol is permitted unless otherwise agreed for specific charters.

The use or possession of illegal drugs is strictly prohibited under Fiji law and will result in immediate termination of the charter without refund and possible referral to authorities.

ADDITIONAL ACTIVITY TERMS

7. Fishing Charters

7.1 Licensing & Regulations

All fishing activities are conducted in accordance with Fiji fisheries regulations. Guests agree to comply with:

  • Size and catch limits
  • Protected species regulations
  • Marine protected area restrictions

Manu Charters reserves the right to release any catch that does not comply with regulations.

7.2 Catch Policy

  • Catch cannot be guaranteed. Fishing is dependent on weather, tides, and natural conditions.
  • Cleaning and filleting of catch is provided only if agreed in advance.
  • Guests are responsible for complying with any transport or export regulations relating to fish.

7.3 Equipment

Fishing equipment provided remains the property of Manu Charters. Guests may be charged for loss or damage due to misuse or negligence.

8. Snorkelling Activities

Snorkelling is undertaken at the guest’s own risk.

8.1 Health & Fitness

Guests must:

  • Be confident swimmers
  • Inform crew of any medical conditions (including asthma, heart conditions, epilepsy, or pregnancy)
  • Follow all safety briefings before entering the water

Children must be supervised at all times by a parent or guardian.

8.2 Equipment

Snorkelling equipment provided must be returned in good condition. Guests may be liable for loss or damage.

8.3 Marine Environment

Guests agree:

  • Not to touch, stand on, or damage coral reefs
  • Not to disturb marine life
  • To use reef-safe sunscreen where possible

Manu Charters promotes responsible marine tourism in Fiji’s fragile reef ecosystems.

9. Private Events & Celebrations

For private events (including birthdays, weddings, corporate charters, and sunset cruises):

9.1 Guest Numbers

Maximum passenger numbers are strictly limited in accordance with Fiji Maritime Safety Authority regulations. Numbers cannot exceed the certified vessel capacity.

9.2 Catering & Decorations

  • External catering must be approved in advance.
  • Decorations must not damage the vessel.
  • Confetti, glitter, open flames, or fireworks are prohibited unless expressly approved.

9.3 Damage

The booking party is responsible for any damage caused by guests during the event.

9.4 Conduct

Manu Charters reserves the right to terminate events involving unsafe, illegal, or excessively intoxicated behaviour without refund.

10. Assumption of Risk & Liability

Marine activities involve inherent risks, including but not limited to:

  • Slips, falls, and injuries
  • Sea conditions
  • Marine wildlife encounters

By participating in a charter, guests acknowledge these risks.

To the fullest extent permitted under Fiji law, Manu Charters shall not be liable for:

  • Loss or damage to personal belongings
  • Personal injury or death except where caused by proven negligence
  • Delays or cancellations outside reasonable control

11. Insurance

Manu Charters maintains all insurance required under Fiji law.

Guests are strongly advised to obtain comprehensive travel insurance covering:

  • Charter cancellations
  • Medical expenses
  • Evacuation
  • Personal belongings

12. Force Majeure

Manu Charters shall not be liable for failure or delay due to events beyond reasonable control, including but not limited to:

  • Cyclones or severe weather
  • Natural disasters
  • Government restrictions
  • Maritime authority directives
  • Fuel shortages
  • Mechanical breakdowns despite proper maintenance

13. Governing Law

These Terms & Conditions are governed by the laws of the Republic of Fiji. Any disputes shall be subject to the exclusive jurisdiction of the courts of Fiji.

14. Acceptance of Terms

By confirming a booking and/or making payment, the client acknowledges that they have read, understood, and agreed to these Terms & Conditions on behalf of all passengers in their booking party.
